A customs compliance program is a structured set of policies, procedures, and internal controls designed to ensure that all import and export operations comply with applicable customs laws and regulations. In the US context, this means complying with regulations from US Customs and Border Protection (CBP) and other federal agencies known as Partner Government Agencies (PGAs).
The need for a formal compliance program is not optional for serious importers. Under the concepts of 'informed compliance' and 'reasonable care' established by the Customs Modernization Act of 1993 (Mod Act), importers have the legal responsibility to exercise reasonable care in all their customs transactions. Ignorance of the law is no excuse, and CBP expects importers to actively demonstrate their compliance.
Under 19 USC 1484, the Importer of Record is legally responsible for the accuracy of all information declared in every entry. This includes tariff classification, value, origin, country of origin marking, and compliance with all applicable regulations.
The consequences of not having a compliance program can be devastating: fines of up to 4 times the value of goods for negligence, penalties of up to the domestic value of goods for fraud, loss of import privileges, exclusion from programs like C-TPAT, and irreparable reputational damage. In contrast, a solid program can serve as a mitigating factor in case of unintentional errors.
An effective compliance program is built on seven fundamental pillars that cover all critical areas of customs operations. Each pillar requires written policies, operating procedures, internal controls, and audit mechanisms.
Each pillar does not function in isolation. Tariff classification affects valuation (applicable rates), origin (product-specific rules of origin), and admissibility (certain HTS codes require permits from specific agencies). An integrated program recognizes these interdependencies and manages them holistically.
If starting from scratch, prioritize tariff classification, valuation, and record keeping. These three pillars cover 80% of compliance risk and are the areas CBP examines most frequently in audits.
Written documentation is essential. Each pillar must have a procedures manual that describes the step-by-step process, responsible individuals, control points, and corrective actions when deviations are detected. CBP highly values the existence of written procedures as evidence of reasonable care.
Tariff classification is arguably the highest-risk area in customs compliance. An incorrect classification can result in overpayment or underpayment of duties, erroneous application of countervailing duties, and violation of government agency regulations. CBP considers misclassification one of the most common and costly errors.
A robust classification program should include: a formal process for classifying new products before their first import, a centralized database of approved classifications, periodic review of existing classifications (especially when there are changes to products or the HTSUS), and a mechanism to escalate difficult classifications to specialists or request ruling letters from CBP.

If you discover that you have been classifying a product incorrectly, you have the option of making a voluntary disclosure (prior disclosure) to CBP under 19 USC 1592. Customs valuation in the United States follows the methods established in the Trade Agreements Act of 1979, based on the WTO Valuation Agreement. The primary method is transaction value: the price actually paid or payable for goods when sold for export to the United States, plus certain adjustments.
Adjustments to transaction value include: assists provided by the buyer to the seller, royalties and license fees paid as a condition of sale, and the proceeds of any subsequent resale that accrue to the seller. These adjustments are frequently overlooked and represent one of the highest-risk areas in valuation.
When buyer and seller are related parties (companies within the same corporate group), CBP may question whether the transfer price reflects a true market value. You must be able to demonstrate that the price was not influenced by the relationship, using sales prices to unrelated parties, deductive, or computed value methods.
Your valuation program should include a valuation questionnaire applied to each new supplier and updated annually. This questionnaire identifies the existence of assists, royalties, rebates, and other elements that affect value. Without this systematic questionnaire, it is very likely that you will overlook adjustments that are mandatory to declare.
Country of origin determination has multiple implications: it determines applicable tariff rates (MFN, preferential, or sanctions), countervailing duties (anti-dumping/CVD), quantitative quotas, marking requirements (country of origin marking under 19 USC 1304), and eligibility for preferential programs such as USMCA.
Country of origin marking is a legal requirement independent of classification and valuation. Every article imported into the United States must be marked in a conspicuous, legible, and indelible manner with the English name of the country of origin. Exceptions are limited and listed in 19 CFR 134.32. Non-compliance results in penalties of up to 10% of the value of the goods.
For USMCA (formerly NAFTA), origin requirements are product-specific and may include tariff classification change, regional value content (RVC), net cost method, or specific technical requirements. Maintaining adequate records of origin rule compliance is critical, as CBP can audit and revoke preferences up to 5 years after entry.
Transshipment (routing goods through a third country to evade tariffs or countervailing duties) is a serious violation. CBP uses advanced data analytics to detect suspicious patterns. Ensure your suppliers provide verifiable origin documentation.
Under 19 USC 1508 and 19 CFR 163, importers are required to maintain all records related to their import operations for a minimum period of 5 years from the date of entry. This includes not only clearance documents but all correspondence, contracts, purchase orders, payments, and any document supporting information declared in the entry.
CBP can request records through a Demand for Records (19 CFR 163.6) and the importer has 30 days to provide them. Failure to produce requested records can result in fines of up to $100,000 per unfulfilled request, plus a presumption of negligence that complicates any defense.
Implement a digital document management system linked to each entry number. This allows rapid retrieval of any document during an audit. Physical filing systems are increasingly unacceptable to CBP.
Record keeping is not just a legal obligation; it is your best defense tool. When CBP questions a classification, valuation, or origin determination, the quality of your records determines whether you can successfully defend your position. Incomplete or disorganized records are interpreted as a lack of reasonable care.
Internal audits are the self-monitoring mechanism of your compliance program. They should be conducted at least quarterly and cover representative samples from each area (classification, valuation, origin, marking, admissibility). The goal is not zero errors but rather detecting trends, correcting systemic issues, and demonstrating continuous improvement.
CBP conducts different types of external audits. The most common are Focused Assessments (FA), Quick Response Audits (QR), and Compliance Assessments. In a Focused Assessment, CBP evaluates your internal controls before reviewing individual transactions. If your controls are strong, transactional review is minimal. This is a direct incentive to maintain a robust program.
If your internal audit uncovers systematic errors (e.g., incorrect classification across multiple entries), consider making a prior disclosure under 19 USC 1592(c)(4). This significantly reduces potential penalties and demonstrates good faith to CBP.
Preparation for a CBP audit begins long before receiving notification. Keeping your program updated, documented, and internally audited is the best possible preparation. When CBP arrives, your team should be able to demonstrate that every customs decision was made with reasonable care and is backed by documentation.
Implementing a compliance program does not have to be overwhelming. It can be done incrementally, prioritizing the highest-risk areas. The following 90-day plan will take you from zero to a functional program that meets CBP's basic expectations.
After the first 90 days, the program enters maintenance and continuous improvement mode. This includes: quarterly audits, updating classifications when there are changes to products or legislation, annual policy review, and ongoing staff training. The program is never 'finished'; it evolves with your business and regulatory changes.
