USMCA (United States-Mexico-Canada Agreement) replaced NAFTA in July 2020. It allows qualifying goods to be traded between the three countries with reduced or zero tariffs. For U.S. companies exporting to Mexico, this typically means 0% import duty — but only if your product meets the rules of origin.
To qualify for USMCA preferential treatment, your product must be 'originating' in the USMCA region. This means one of:
Each tariff heading has its own rule. The most common types:
Your finished product must be classified under a different tariff heading than its non-originating inputs. Example: if you import Chinese steel (Chapter 72) and manufacture it into steel furniture (Chapter 94), the tariff shift from Ch. 72 to Ch. 94 satisfies the rule.
A minimum percentage of the product's value must come from the USMCA region. Two calculation methods:
If non-originating materials make up less than 10% of the transaction value (or 7% for textiles), the product may still qualify. This is a safety valve for products that barely miss the full rule.
USMCA has the strictest automotive rules of origin of any trade agreement. Passenger vehicles require 75% RVC (up from 62.5% under NAFTA). Core auto parts require 75% RVC. Steel and aluminum must be melted and poured in the USMCA region. There are also Labor Value Content (LVC) requirements — a percentage of the vehicle must be produced by workers earning $16+/hour.
Under USMCA, certificates of origin can be self-certified — no government approval needed. The certificate can be issued by the exporter, the producer, or the importer. It must include:
USMCA does not require a specific form. The certificate can be a letter, a data field on your invoice, or a standalone document — as long as it contains the required data elements per Article 5.2.
