Master the US HTS system: tariff structure, USITC tools, binding rulings, penalties for misclassification, and how to ensure your products are correctly classified.
The Harmonized Tariff Schedule of the United States (HTSUS or simply HTS) is the tariff classification system used by the United States to determine applicable duties on imported goods. Like Mexico's TIGIE, the HTS is based on the World Customs Organization's Harmonized System (HS), meaning the first 6 digits are identical internationally. However, the United States adds 4 additional digits (for a total of 10) that are specific to its system.
For importers and exporters, understanding the HTS is fundamental for two reasons: first, you need to know the correct classification of products in the US to determine the duty rate (or whether it qualifies for USMCA preferential treatment). Second, an incorrect classification in the US can create problems for both the US importer and the foreign exporter, including loss of preferential tariffs, fines, and goods detention.
TIGIE (Mexico): 8 digits (HS 6 + 2 national). HTS (US): 10 digits (HS 6 + 4 national). The first 6 digits are identical. Example: Laptops = 8471.30 in both systems. In Mexico: 8471.30.01. In the US: 8471.30.0100.
The HTS is organized into 99 chapters (chapters 98 and 99 are US-specific with no HS equivalent). The hierarchical structure is similar to the Harmonized System but with greater detail.
The Section Notes, Chapter Notes, and General Rules of Interpretation (GRI) of the HTS are identical to those of the Harmonized System and apply in the same way as in Mexico. This facilitates correspondence between classifications, although national levels may differ.
The United States International Trade Commission (USITC) is the federal agency responsible for maintaining and publishing the HTS. Its website (hts.usitc.gov) is the official, free source for looking up the tariff classification of any product imported into the United States.
Before importing a new product, consult the HTS on the USITC website to identify the probable classification and applicable duty rate. Then search CROSS for any CBP ruling on a product similar to yours. This will give you greater certainty about how your product will be classified at US customs.
Binding rulings are official decisions issued by CBP establishing the correct tariff classification for a specific product. Once issued, the ruling is binding: CBP must apply that classification when the product is presented at customs. They are the US equivalent of Mexico's advance classification criteria.
US tariff rates are found in Columns 1 and 2 of the HTS. Column 1 is subdivided into 'General' (MFN rate for most countries) and 'Special' (preferential rates under FTAs and unilateral programs). Column 2 applies to countries without normal trade relations (currently Cuba and North Korea).
Additional Section 301 tariffs on Chinese products have transformed global supply chains. Many products previously imported from China to the US are now manufactured or assembled in Mexico under IMMEX and exported to the US at 0% duty under USMCA. This is one of the main drivers of nearshoring in Mexico.
CBP takes tariff classification very seriously. Penalties for misclassification can be significant and affect both the US importer and indirectly the foreign exporter who provided incorrect information.
CBP conducts post-importation audits called Focused Assessments on selected importers. They review classification, valuation, and origin of goods imported over the past 5 years. Consistently incorrect classification can result in retroactive collections and accumulated penalties.
For a product exported from Mexico to the United States to enjoy the USMCA preferential tariff rate (generally 0%), it must be correctly classified under the HTS and comply with the treaty's specific rule of origin. The HTS classification determines which rule of origin applies.
It is possible for a product to have a different national classification in Mexico (TIGIE 8 digits) and in the US (HTS 10 digits), even though the first 6 digits are the same. Always verify the classification in both countries and ensure the USMCA rule of origin is met under the US HTS classification.
Correct tariff classification is the foundation of the entire foreign trade process, both in Mexico and the United States. A classification error can result in loss of USMCA preferential tariffs, overpayment or underpayment of duties, and legal problems on both sides of the border. Investing in correct, documented classification is one of the best decisions an importer or exporter can make.
